What to Do After a Car Accident in NSW

If you’ve just had a crash in Sydney (or anywhere in NSW), breathe. This guide shows you exactly what to do step-by-step including when to call police, how to collect evidence, arranging a tow, and how insurance/CTP works. 1) Make the scene safe (first, always)

  • Check for injuries. If anyone is injured, trapped or unconscious, call 000 immediately and request ambulance and police. Police also attend if a driver is suspected of alcohol/drugs, someone refuses to exchange details, traffic needs directing or a bus/truck needs towing. (NSW Government)
  • Switch on hazard lights, use a warning triangle if you have one, and move to a safe spot off the roadway if the car can be moved.
  • Don’t discuss fault at the scene, stick to facts for your insurer/police later.

2) Exchange the right details (it’s the law)

Swap with all involved drivers (and property owners if applicable):

  • Full name and address
  • Vehicle rego and owner’s name/address (if the driver isn’t the owner)

3) Photograph everything (protect yourself)

Take wide and close photos of:

  • All vehicle damage, positions on the road, skid marks/debris
  • Number plates and driver licences (if they agree)
  • Street signs, traffic lights, lane markings, speed signs
  • Any injuries and weather/lighting conditions

4) Do you need police now or just to report later?

You don’t need police to attend if there are no injuries and no towing is required. (NSW Government)

However, if police do not attend, you must report the crash as soon as possible (within 24 hours) if any of the following apply:

  • A vehicle is towed away
  • Property is damaged or animals are injured
  • You couldn’t exchange details at the scene

5) Choosing and authorising a tow truck (your rights)

If your vehicle needs towing, you choose:

  • Who tows your vehicle and where it goes (home, your mechanic, smash repairer, holding yard).
  • NSW accident tow trucks must be authorised (special TT number plates) and the driver must hold a valid certificate. You’ll sign a Towing Authorisation Form, and you’re entitled to a copy. (NSW Government)

6) Insurance next steps (property damage)

  • See your GP promptly and ask for a SIRA Certificate of Fitness/Capacity to include in your claim.
